In no event shall Wise Wallet be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with your use of the Site or Services, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, even if Wise Wallet has been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or relating to these Terms or the Site or Services shall not exceed the amount you paid to Wise Wallet for the Services in the twelve (12) months preceding the claim, or one hundred US dollars ($100), whichever is greater.
You agree to indemnify, defend, and hold Wise Wallet harmless from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your use of the Site or Services, your violation of these Terms, or your violation of any rights of another party.
Any dispute arising out of or relating to these Terms or the Site or Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in Austin, Texas. The arbitrator's decision shall be final and binding on both parties.
You agree that any claim or cause of action arising out of or related to these Terms or the Site or Services must be filed within one (1) year after such claim or cause of action arose, or it will be forever barred.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
Wise Wallet reserves the right to modify or update these Terms at any time without prior notice. Your continued use of the Site or Services after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically for any changes.
Wise Wallet may terminate your access to the Site or Services at any time, with or without cause, and without prior notice. You may terminate your account at any time by contacting us at support@wisewallet.com.
Upon termination, your right to use the Site and Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to provisions regarding intellectual property, disclaimers of warranties, limitations of liability, indemnification, and dispute resolution.
